Financial difficulties and divorce are often paired in the same sentence, and for good reason. Having a
stable marriage is one of the most precious gifts you can give your children. However, that is not always possible. Once a couple made, the decision to get a divorce.
There’s an array of problems that follows after divorce of which one of the most prominent problems,
Financial Difficulties.
In a society where both partners in the household are working to provide for their family, suddenly each must take care of themselves. There are extra monthly expenses that will stay part of the monthly budget even after the divorce.
What type of expenses will I incur when getting divorced?
Attorney fees:
One of the spouses in the marriage will have to issue summons for divorce, and therefore an Attorney is needed to proceed with the divorce proceedings.
Divorce can be more affordable if it's finalised quickly and efficiently, but only if both parties settle beforehand and don’t start fighting about trivial things.
On the other hand, the cost of a divorce can be exorbitant, and a long unforgiving process if the parties involved decide to fight about assets, children, etc.
Maintenance:Maintenance is monthly money due to aid in the spouse / minor children’s needs. This monies will stay part of your budget until the children are all grown up and finished with their studies.
In all probability, the amount can increase annually as the needs of the child increase as they grow older.
Once again this will depend on your specific set of circumstances, and we urge you to consult with your divorce lawyer regarding maintenance.
Bridging Maintenance are also applicable to the spouse to assist the individual moving out of the family home to start afresh in a place of his / her own. However, this type of maintenance is not a permanent and will depend on circumstances.
Read more about what the Law states about Maintenance in South Africa in the
Maintenance Act 99 of 1998.
Additional Monthly Expenses:
The spouse that moved out of the communal home will suddenly have additional expenses like rent, groceries, fuel, water & electricity, etc. which did not necessarily form part of their monthly expenses, since the partner with the greatest income most likely covered the bulk if not all these expenses monthly.
Men and Woman alike are
impacted by divorce, emotionally and financially. We see a lot of divorcees coming through our doors with financial problems.
Why is it that after Divorce Financial Difficulties follow?
Whilst being married, household expenses are shared as well as the monthly expenses towards taking care of our children. After Divorce the household expenses aren’t shared anymore, and the financial burden will transfer to each divorcee individually.
Clearly, Divorce and financial difficulties go hand in hand:
Therefore, it’s inevitable to go through a divorce without having to juggle several additional expenses after divorce. If there’s children in the marriage, most of those expenses will stay, until such time that the children have started their own lives, and care for themselves.
